Privacy Policy
Effective Date: October 8, 2026 | Last Updated: October 19, 2026
In Plain English
- Talk Kit is a voice AI widget. When you talk to it, your voice is recorded, transcribed and processed by AI service providers so it can understand you and answer.
- On another business's website, that business decides how your information is used. We process it for them.
- On talkkit.ai, and for our own Customers' accounts, Talk Kit decides how information is used, as described here.
- We never take card numbers through the voice conversation. Payments run through Stripe.
- Questions or requests: email [email protected].
Bigly Sales, Inc., doing business as Talk Kit ("Talk Kit," "we," "our," or "us"), respects the privacy of the people who use our website at talkkit.ai, our voice AI widget and our related services (together, the "Services"). This Privacy Policy explains what personal information we collect, how we use and share it, and the choices and rights you have. By using the Services, you acknowledge the practices described in this Privacy Policy.
Who This Policy Covers
This Privacy Policy applies to three groups of people:
- Website visitors: people who browse talkkit.ai or join a waitlist there.
- Customers: businesses (and the people acting for them) that sign up for a Talk Kit plan and add the widget to their own websites.
- Callers: people who use the Talk Kit widget to talk with an AI voice assistant, either on talkkit.ai or on a Customer's website.
Our Role Versus Our Customers' Role
On a Customer's website. When you talk to Talk Kit on a business's website, that business (our Customer) decides why and how your information is collected and used. Under privacy laws the Customer is the "controller" or "business," and Talk Kit acts as its "processor" or "service provider," handling your information on the Customer's behalf and under its instructions. The Customer's own privacy policy governs how it uses your information, and requests about that information should go to the Customer first. If you contact us about a Customer's data, we will refer your request to that Customer or help it respond.
On talkkit.ai and for Customer accounts. For people who visit talkkit.ai, talk to the widget on talkkit.ai, or sign up as Customers, Talk Kit is the controller of the personal information described in this Privacy Policy.
Information We Collect
Information You Give Us
- Call form details: before a voice conversation starts, the widget asks for your first name, last name, phone number and email address.
- Consent records: the widget shows consent text for marketing contact before a call starts. We keep a record of your consent.
- Voice conversations: what you say to the AI and what it says back, as audio recordings and written transcripts (see the next section).
- Waitlist sign-ups: your email address and where you signed up from.
- Customer account information: contact and business details such as name, email address and phone number, plan and billing status, and the settings, content and staff phone numbers a Customer gives us to configure the widget.
- Support requests: anything you tell us, or tell the AI, when asking for help, suggesting a change or reporting a problem.
Information Collected Automatically
- Device and connection data: IP address, browser type and user agent, the page that referred you (referrer), and the time of your visit. Our waitlist form stores your IP address, user agent and referrer alongside your email address.
- Usage and call data: when a call starts and ends, its length in minutes, which features were used (for example, a live transfer, booked appointment, text message or payment link) and technical logs that help us keep the Services running.
- Performance data: aggregated page-load and visit statistics from Cloudflare, our hosting provider, collected without cookies. See our Cookie Policy.
Information From Customers
Customers give us content from their own websites and business instructions so the AI can answer questions accurately. This content may include names and contact details of the Customer's staff, such as the phone numbers used for live transfers.
Voice Conversations, Recordings And AI
- Microphone access. The widget uses your device's microphone only after you start a conversation and your browser grants permission. You can deny or revoke microphone access in your browser settings at any time.
- Recorded line. Conversations take place on a recorded line: they are recorded and transcribed. If you do not want to be recorded, do not start a conversation, or end it at any time.
- AI processing. To understand you and respond, your audio and transcripts are processed by third-party AI service providers such as Microsoft Azure OpenAI, OpenAI and Fish Audio. Depending on the engine a Customer chooses, this includes speech-to-text, a large language model and text-to-speech, or a speech-to-speech model that does all three at once.
- You are talking to an AI. The voice you hear is generated by AI. It is not a human, unless the AI transfers you to a live person at the business.
- Model training. We do not use call recordings or voice data to train AI models without explicit written consent from the Customer whose widget handled the call. Voice data is used to operate the Services.
- Please do not share sensitive information by voice. Do not say card numbers, bank details, Social Security numbers, health information or passwords to the AI. Payments are handled through a secure Stripe link, never through the conversation.
How We Use Personal Information
We use personal information to:
- run voice conversations, answer questions, qualify interest, book appointments, send links by text message, send payment links and live-transfer calls to a Customer's staff;
- deliver call details, transcripts, recordings and leads to the Customer whose widget you used;
- contact you as you consented to, including by phone, text message, AI voice and email;
- create and manage Customer accounts, measure voice minutes used, and bill for plans and overage;
- respond to support requests and improve the Services, including by reviewing support requests and call quality;
- manage waitlists and tell you when Talk Kit is available to you;
- detect, prevent and investigate fraud, abuse, security incidents and violations of our Terms Of Use; and
- comply with applicable laws and regulations, and enforce our rights.
How We Share Personal Information
We share personal information only as described below:
- With the Customer whose widget you used. Your call form details, consent record, transcript, recording and call outcome go to the business whose website you were on. That business may contact you and use your information under its own privacy policy.
- With service providers. We use vendors that help us operate the Services, including hosting and content delivery (Cloudflare), website analytics (Google Analytics), real-time voice infrastructure, AI speech and language providers, telephony and text messaging carriers, email delivery and payment processing (Stripe). We do not authorize them to use personal information for any purpose other than providing their services to us.
- Within our corporate family. Talk Kit runs on infrastructure operated by our parent company, Bigly Sales, Inc., which processes information for the purposes in this Privacy Policy.
- To comply with law. When required by a government agency, court or other authority, such as in response to a subpoena, court order or law enforcement request, or to protect the rights, property or safety of our users, the public or us.
- In a change of control. In a merger, acquisition, bankruptcy, sale of assets or similar transaction, information may be transferred to the successor or acquirer.
- With your consent. When you ask us to or agree to it.
We may also use and share aggregated or de-identified information that cannot reasonably be used to identify you.
We do not sell personal information collected through the Services, and we do not share it for cross-context behavioral advertising.
SMS, Text Messaging And Mobile Information
If you give your mobile number and consent to receive text messages, the following applies to that mobile information:
- No sharing for marketing. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared, sold, rented, leased, traded or otherwise disclosed to any third party or affiliate.
- Delivery only. The only parties that may receive your mobile information are the SMS aggregators, wireless carriers and messaging platform providers strictly necessary to deliver the messages you requested. They are contractually prohibited from using it for any other purpose or disclosing it further.
- What we send. Messages may include links you asked for during a conversation, appointment confirmations, payment links and, where you separately opted in, marketing messages. The business named in the consent text is the sender.
- Frequency and rates. Message frequency varies. Message and data rates may apply.
- Opting out. Reply STOP to any message to stop receiving texts. Reply HELP for help, or email [email protected].
- Carriers. Mobile carriers are not liable for delayed or undelivered messages.
- Deletion. To ask us to delete your mobile number and consent records, email [email protected].
Consent to receive marketing texts is not a condition of any purchase. This section controls over any other part of this Privacy Policy that conflicts with it about mobile information or text messaging consent.
Payments
Customer subscription payments and any payment links sent during a conversation are processed by Stripe. Card details are entered on Stripe's secure pages and never pass through the voice conversation or talkkit.ai. Subscription checkout runs through app.biglysales.com. Stripe handles payment information under its own privacy policy at stripe.com/privacy. We receive information about the status of payments from Stripe, but never your full card number.
Cookies And Similar Technologies
talkkit.ai uses Google Analytics cookies to measure visits and traffic sources. It does not use advertising cookies. Our Cookie Policy lists exactly what the site and widget use and how to control it.
How Long We Keep Information
We keep personal information only as long as needed for the purposes in this Privacy Policy, to comply with legal obligations, to resolve disputes and to enforce our agreements. In particular:
- Call recordings are stored on secure U.S.-based servers and kept for 90 days, unless a longer period is required by law or requested in writing by the Customer.
- Consent records are kept as long as needed to show that consent was given.
- Customer account and billing records are kept for as long as the account is active and afterwards as required for tax, accounting and legal purposes.
- Waitlist entries are kept until you ask us to remove them or we no longer need them.
Personal information not subject to a specific retention period is kept for at least two years and then archived or deleted when it is no longer needed for any lawful purpose.
Information Security
We maintain reasonable administrative, technical and physical safeguards to protect personal information, including encryption in transit. No security system is perfect, and we cannot guarantee that information will never be accessed, used or disclosed in a way this Privacy Policy does not allow.
Customers configure Talk Kit through the Talk Kit MCP using a scoped access token. Customers are responsible for keeping that token secret, for the AI coding agents they authorize to use it, and for telling us right away if they think it has been exposed.
Children's Privacy
The Services are not intended for anyone under 13, and Customers may not use Talk Kit to collect information from children under 13. We do not knowingly collect personal information from children under 13. If we learn that we have, we will delete it. If you believe a child has given us information, contact us at [email protected].
Your Choices
- Do not start a call. Using the voice widget is optional. You can read the website instead, and you can end a call at any time.
- Microphone. You can block or remove microphone permission in your browser.
- Texts. Reply STOP to any text message.
- Email. Use the unsubscribe link in any marketing email. Customers will still receive account and billing notices.
- Cookies and storage. See our Cookie Policy.
U.S. State Privacy Rights
Depending on where you live, including California, Colorado, Connecticut, Montana, Nevada, New Jersey, Oregon, Texas, Utah and Virginia, you may have some or all of the following rights over personal information for which Talk Kit is the controller or business, subject to exceptions in the law:
- Know and access: learn what personal information we collect, use and disclose, and get a copy of it.
- Portability: receive your information in a portable, readily usable format.
- Correct: ask us to correct inaccurate information.
- Delete: ask us to delete information we collected from or about you.
- Opt out: opt out of the sale of personal information, targeted advertising and profiling that produces legal or similarly significant effects. As stated above, we do not sell personal information or use it for targeted advertising.
- Limit sensitive data: limit the use of sensitive personal information. We ask Customers and callers not to provide sensitive information through the Services.
- Non-discrimination: we will not deny you service, charge you a different price or give you a different quality of service for exercising your rights.
California "Shine The Light." California residents may ask once a year for information about personal information we disclosed to third parties for their direct marketing purposes in the prior year. We do not make such disclosures.
Nevada. Nevada residents may submit a request directing us not to sell covered information. We do not sell covered information, but you may still submit a request.
How to make a request. Email [email protected] with the subject line "Privacy Request," say which right you want to use, and include the email address or phone number you used with Talk Kit. To delete a voice call's data, use the subject line "Call Data Deletion Request." If your information was collected on a Customer's website, we will refer your request to that Customer, as the law requires, or help it respond.
Verification and authorized agents. We will verify your request by matching information you give us with information we hold. An authorized agent may make a request for you with your signed permission, and we may ask you to confirm your identity directly.
Timing. We aim to respond within 45 days. If we need more time, up to another 45 days, we will tell you why. We respond to call data deletion requests within 30 days and confirm deletion in writing. We do not charge a fee unless a request is excessive, repetitive or manifestly unfounded.
Appeals. If we decline your request, you may appeal by replying to our decision or emailing [email protected] with the subject line "Privacy Appeal." If you are not satisfied with the result, you may contact your state attorney general.
Do Not Track. Some browsers send a "Do Not Track" signal. Because talkkit.ai does not track you across other websites for advertising, no special response is needed.
If you have a disability and need this Privacy Policy in another format, email [email protected].
International Visitors
Talk Kit is operated from the United States, and personal information is stored and processed in the United States and in other countries where our service providers operate. Those countries may have data protection laws that differ from yours.
If you are in the European Economic Area, Switzerland or the United Kingdom, we process personal information for which we are the controller on these legal bases: to perform a contract with you (such as providing a Customer's plan); for our legitimate interests (such as running, securing and improving the Services and responding to inquiries); to comply with legal obligations; and with your consent (such as for recording and marketing contact), which you may withdraw at any time.
You have the right to access, correct or erase your personal information; to restrict or object to its processing; to data portability; and to withdraw consent. To exercise these rights, email [email protected]. You also have the right to complain to the data protection authority where you live.
Changes To This Policy
We may update this Privacy Policy by posting a new version on this page, and by any other notice method the law requires. The "Last Updated" date at the top shows when it last changed. Changes take effect when posted. Please check this page from time to time.
